City of Tangerang is one of buffer zone of capital DKI Jakarta. But the reality occurred is that in City of Tangerang still has many sale and purchase transaction of land that has certificate conducted by private without involving Land Titles Registrar, so when processing registration of its land rights transfer at Land Office encounters hardships as the seller can not be located his whereabouts. Therefore this research’s objectives were to learn status of sale and purchase privately made over certified land without sale and purchase deed issued by Land Titles Registrar (PPAT) and its settlement process conducted by buyer in order the sale and purchase has definite legal power and able to meet publicity principles. In this research juridical normative method and juridical empirical were used. In which the data used were primary and secondary data. Primary data was obtained by interviewing sources. While secondary data was derived from law and regulation, sale and purchase documents, books and internet publication. Those data was analyzed by considering the facts in field then withdrew a conclusion in form of argumentation to answer these legal issues. Result of this research was status of sale and purchase privately made over certified land without sale and purchase deed published by PPAT for an instance were cases of Court Ruling Number 487/Pdt/2015/PN.TNG and 207/PDT.G/2006/PN.JKT.BRT, they were legal despite it was just in form of a receipt. It was based on Jurisprudence of Supreme Court No.126.K/Sip/1976 dated 4 April 1976 and on Court Ruling Number 424/PDT.G/2009/PN.TNG, was also legal according to law in conformity with article 613 Code of Civil Law. Settlement process conducted by buyer in order this sale and purchase has definite legal power and able to meet publicity principles namely by proposing legal effort to District Court to yield District Court Ruling as requirements to process registration of its rights transfer to Land Office of Tangerang City. Contribution for Ministry of Agrarian and Spatial/BPN is as a consideration material to determine a more effective, efficient and transparent steps and policies presented to public specifically in connection with registration of land rights transfer by sale and purchase, so public interest and knowledge improves in conducting sale and purchase of certified land based on applicable provision namely by making sale and purchase Deed published by PPAT beforehand before registering its rights transfer to Land Office.
