Supreme Court Verdict No. 354K/TUN/2008 is a case verdict of State Administrative between Heng Djie Djuan (Plaintiff) against Sinar Damanik et al (Defendants) and has permanent legal force. This case was based on Defendants’ dissatisfaction on Supreme Court verdictNo.2262 K/Pdt/1993 with injuction canceling letter of property rights (SHM) No. 54/Gung Letoand the transfer occurred on it (SHM No. 60, 61 and 68/Gung Leto). Based on this basic civil verdict, published new certificate on case object land namely SHM No. 898/Gung Letoon behalf of Sinar Damanik et al. Case object in form of land located in Gung Leto Village, Kabanjahe sub district, Karo District and occupied by defendants (heirs). At cassation level in State Administrative Court, one of the injunction points stating that SHM SHM No. 898/Gung Leto published based on civil verdict which has permanent legal force was void by law (null and void). This verdict supposed to be held by Land Office of Karo District however in reality it did not. This condition was implied on the implementation of land administration action since it was not able to provide legal certainty guarantee for litigants. Data maintenance of this land registration was conducted to meet the land registration objectives and advanced principle of land registration.
The objective of this research was to discover the cause of ownership dispute of SHM No. 898/Gung Leto and its juridical implication for the parties if the Supreme Court verdict No.354K/TUN/2008is not or has not been executed associated with the change of its land registration data. Research method used in this study was juridical normative and juridical empiric with statute approach and analysis approach. Legal and non legal material was collected and processed for further analysis and was made a conclusion to answer problem formulation in this research.
Based on research result and analysis, can be concluded first, factor causing ownership dispute of SHM No. 898/Gung Leto was bad intention of former buyer (SampitTarigan), and second, implication of Supreme Court verdict No. 354K/TUN/2008on the implementation of administrative action conducted by Land Office of Karo District was the implementation of State Administrative verdict was not necessarily civil rights will be transferred to the winner in State Administrative case. The absence of recording regarding cancelation of rights of ownership No. 898/Gung Letoon land book and other general lists was resulting in unfulfilled of advanced principles and land registration’s objective.
