The transfer of right to land through sale and purchase is regulated in Article 37 paragraph (1) of Government Regulation Number 24 of 1997 concerning Land Registration, stipulates that any transfer of land ownership through sale and purchase agreement must be proven by Land Titles Registrar (PPAT). However the communities in Harapan Jaya Village do not use the sale and purchase agreement made by Land Registrar (PPAT) for their land transactions, especially transmigration lands. The practice of land transactions is better known as land sale and purchase under the hand. The purpose of this research is find out the causative factors of land transaction under the hand, the validity of the sale and purchase of the land and the registration of ownership rights after the land right transfer in the Land Office which not proven by Land Titles Registrat (PPAT).
This research uses a normative juridical and empirical juridical methods with a statutory approach and a case approach. The reseach conducted an analysis with land acquisition regulations and analyzed the problem that occured in the field in order to find a settlement strategy. The data were collected through observation, document study, and interview with purposive sampling technique.
The result of the research on the land rights sale and purchase under the hands of Harapan Jaya Village were due to the low cost and the easy process, apart from the lack of knowledge about the procedures for land sale and purchase and the high mutual trust that occurs in the community. The sale and purchase under the hand is legal according to custom law but does not fulfill the legal requirements of the agreement in Article 1320 of the Civil Code. The registration of the transfer of land ownership The Head of the Land Office makes a discretion or policy addressing these problems by looking at the provisions in Article 37 paragraph (2) of Government Regulation Number 24 of 1997.
